I agree to pay the following charges: $100 per initial hour and $50 per hour for the each additional hour on Abbey Farms Property prepaid to Abbey Farms. The photographer agrees to schedule a time with Abbey Farms PRIOR to entering the property (Abbey Farms is an operational farm with equipment and off-limit
areas).
1. I understand that Marmion Abbey Farms is offering the right to enter the property with met conditions (hereinafter called the “Program”) during the period of November 2, 2024 to November 17, 2024
2. I understand that Marmion Abbey Farms will not provide supervision for the Program, and cannot guarantee the absolute safety of the Participant.
By checking the box the participant is stating that they are responsible for his/her conduct and his/her own safety during the Program. I further understand that the Participant is responsible for obeying all the rules of the Program, including but not limited to:
1. The Participant will not smoke at any time during the Program;
2. The Participant will not film any public visitors during the course of the work day
3. The Participant will not use, or have in his/her possession for any purpose whatsoever, alcoholic beverages or illegal drugs;
4. The Participant will be sensible, cooperative and obedient to all supervisors;
5. The Participant will obey such other rules as the supervisor may from time to time require.
3. I understand and agree that if the participant does not observe the rules set forth above, the supervisor may dismiss filming crew for the day.. I understand and agree that the supervisor has the right, in his or her own discretion, to send the Participant home temporarily or permanently.
4. I expressly give my permission for the administration of any emergency medical treatment to the participant deemed necessary by a licensed physician, dentist or medic and have signed the attached Authorization for Medical Treatment. I also agree and acknowledge that I am responsible for emergency expenses which may be incurred by the Participant during or arising out of the Participant’s participation in the Program included but not limited to transportation and medical treatment.
5. In consideration of the Participant’s being allowed to enter Marmion Abbey Farms Property, on behalf of the Participant and for myself, (a) I agree that the Participant and I assume all risks in connection with the Program, (b) I fully release Marmion Abbey Farms, the Marmion Benedictine Community of Aurora
Illinois and their members, employees, and volunteers from any liability whatsoever for any damages incurred by the Participant and/or me during or arising out the Participants participation in the Program, including all the risks connected therewith, whether foreseen or unforeseen, and (c) I agree to save and
hold harmless Marmion Abbey Farms, the Marmion Benedictine Community of Aurora Illinois and their members, employees and volunteers from any claim by the Participant, myself or the participant’s heirs, executors, administrators, personal representatives, or assigns arising out of the Participant’s enrollment in the Program
6. I have fully informed myself of the Consent and Release by reading it and understanding the terms herein are contractual and not mere recitals.
7.CONDUCT: Lessee agrees to conduct the function in an orderly manner in full compliance with applicable state and federal laws and regulations,
including rules set forth by Abbey Farms. Lessee assumes full responsibility for all conduct of all persons in attendance and for any damages, loss, or liability
incurred therein. Abbey Farms and its owners reserve the right to refuse the patronage and service of any Lessee or guest(s) if they do not apply accordingly.
8. BEHAVIOR: Abbey Farms reserves the right to refuse service to or ask any guest, patron or visitor of The Nagel Emporium, Abbey Farms or Marmion Inc. to leave the premises for such reasons as, but not limited to, unruly and/or dangerous behavior, improper clothing or lewd acts, or disregard for NEAF policies including photo restrictions, noise, and damage to property.
9. CONCEALED WEAPONS: Pursuant to 430 IL CS 66/65, no concealed weapons are allowed NEAF or its outbuildings or on Abbey Farms or Marmion, Inc., grounds.
10. COMPLIANCE WITH THE LAW: This agreement is subject to all applicable federal, state, and local laws including health and safety codes, alcoholic beverage control laws, disability laws, and the like. The parties agree to cooperate with each other to ensure compliance with such laws.
Special Events/Promotional Events Use of Facility Clause
The use of NEAF, Abbey Farms, Marmion Abbey, Marmion Academy or any of Marmion’s grounds may not be used for any special/promotional event(s) (public or private) without prior written approval from an Abbey Farms representative. At no time should any of Marmion’s facilities or grounds be used for partisan politics or the support or opposition of any candidate. Promotional material containing photos, videos, logos, or written material of part or any of NEAF, Abbey Farms, Marmion Abbey, Marmion Academy or any of Marmion’s grounds may not be distributed, publicly or privately, without prior written approval from an Abbey Farms representative.
Any and all individuals, organizations, and/or groups (i.e organizations, charities, non-profits, fund-raisers, etc.) that are being promoted by Lessee and wish to use any of the aforementioned areas on Marmion property must be per-approved by an AF representative. Lessee must state his/her true intentions of proposed event at the initial meeting. Upon review, NEAF reserves the right to refuse rental for said event if it does not adhere to Marmion’s “Use of Facility” policy. Lessee may not sub-lease or re-lease venue to any individual or group without prior written approval by an Abbey Farms representative. Lessee agrees that should this situation arise, Abbey Farms reserves the right to immediately cancel this agreement and the scheduled event, and Lessee forfeits all monies paid for event.
